Employment law is comprised
of
federal/state laws,
administrative rulings, and
legal precedents and best
practices which encompass
all areas of the
employer/employee
relationship. Employment law
is governed by thousands of
federal and state statutes,
administrative regulations,
and judicial decisions. Some
of the topics included in
employment law are:
employee benefits (health &
welfare), 401k plans,
employment discrimination,
hiring, termination, harassment, wages,
unemployment compensation,
pension plans, workplace
safety, workers’
compensation and many other
areas not specifically
mentioned here. Human Resources
professionals are important
players in the workplace and can assist
companies manage and
implement employment laws
through policies and
procedures. However, in the
absence of the advice,
support, and representation
of competent legal counsel, many companies
fail to keep abreast of
the rapidly changing laws
governing employment, engage
in poor decision making
relative to the employer and
employee relationship and
consequently are
ill-equipped to effectively
implement necessary changes within their
companies to maintain
compliance and avoid legal
pitfalls. In these
instances, the workplace can
devolve into a hot bed of
